CONTRACTUAL TERMS OF SALE

1. Introduction

The following terms and conditions of sale form an integral part of the contract between you, the Client, and Tropical Home. We kindly ask you to read them carefully.

2. Booking, Contract Conclusion, and Payment Terms

Reservations may be made through Tropical Home services, in writing, by telephone, online, or via a partner organization with a collaboration agreement with Tropical Home. A deposit of 25% of the rental price must be received by Tropical Home within 72 hours of the booking date. The contract will be considered concluded upon receipt of the deposit.

If payment is not received within the 72-hour period, Tropical Home reserves the right to release the reserved accommodation. The remaining balance must be paid no later than 30 days before the arrival date. For late bookings (less than 30 days before the start of the stay), the full rental amount is due on the booking date. The contract is therefore subject to the receipt of full payment.

Any Client who fails to pay the balance by the agreed date will be considered to have canceled their stay. Tropical Home will be released from all obligations. The accommodation will be offered for resale, and no refund will be issued.

Upon receipt of full payment and prior to the start of the stay, Tropical Home will send the Client the contact details of the person responsible for check-in and all relevant information to reach the accommodation.

3. Services and Prices

The number of people allowed per accommodation includes all occupants: adults, children, and infants. The price includes tourist taxes and mandatory end-of-stay cleaning.

Payment for utilities and available supplies is also included in the price (tap water, electricity, internet access). The use of water and electricity (lighting, air conditioning, appliances) is included within the limits of reasonable usage.

AIR CONDITIONING: Continuous use or operation with windows/doors open is not considered reasonable usage.

ELECTRIC VEHICLE: Charging electric vehicles is prohibited.

The property's electricity meter is equipped with an hourly consumption monitoring system. In case of significant overconsumption compared to the average for similar occupancy, an additional fee will be charged.

HOUSEHOLD LINEN: Linen is provided.

If the Client requests a linen change during their stay, this optional service is available for bookings of 14 nights or more upon request (charged at €16 incl. VAT per person).

Tourist and practical information (transport, shops, restaurants, etc.) is provided for reference only and is regularly updated. However, this information is subject to change without notice. It is the Client's responsibility to inform themselves about their destination.

4. Price and Service Modifications

Accommodation descriptions and published prices are prepared with the utmost care. However, changes may occur (price, equipment, or service modifications). In case of discrepancies, the information in the booking confirmation or invoice shall prevail. Payment of the deposit or balance constitutes acceptance of these updated terms, even if they differ from those initially viewed online.

5. Check-in and Check-out - Shortened or Extended Stay

Check-in must occur between 3:00 p.m. and 7:00 p.m., and check-out between 8:00 a.m. and 11:00 a.m. If the Client cannot meet these times or the scheduled arrival date, they must make prior arrangements with the person in charge of check-in (a €50 surcharge applies for late arrivals after 7:00 p.m. or early departures before 8:00 a.m.). No refund will be issued if the Client fails to check in at the agreed time. The same applies to shortened stays. If the Client wishes to extend their stay, they must make the request to Tropical Home in due time to verify availability. Except in the cancellation cases provided in Article 6 below, the full rental amount remains due if the Client does not take possession of the accommodation for any reason.

Any unauthorized check-out after 11:00 a.m. will result in a charge equivalent to one additional night.

6. Cancellations

For any cancellation, cancellation fees will be charged based on the time between the cancellation date and the start of the stay, according to the following scale:

• More than 28 days: 25% of the total amount (excluding cleaning fees and tourist taxes)

• Between 28 and 15 days: 50% of the total amount (excluding cleaning fees and tourist taxes)

• Between 14 and 8 days: 75% of the total amount (excluding cleaning fees and tourist taxes)

• 7 days or less: 100% of the total amount (excluding cleaning fees and tourist taxes)

In case of no-show or cancellation on the arrival day, the full stay remains due with no refund. All cancellations must first be communicated to Tropical Home by phone and then confirmed in writing (letter or email). The date of receipt (working day) of this written notice will be taken into account. If cancellation occurs on a public holiday, the period will begin on the next working day.

7. Contract Termination by Tropical Home

If unforeseen circumstances or force majeure events make the accommodation unavailable, Tropical Home reserves the right to cancel the contract before the stay and, where possible, offer the Client alternative accommodation of similar value. A new written contract will then be issued. If no alternative solution can be found, Tropical Home will inform the Client by phone or email, and the Client will receive a full refund of any amounts paid.

8. Client Obligations

SECURITY DEPOSIT: Upon arrival, the Client must provide the required security deposit via pre-authorization on a credit card. Without this deposit, access to the accommodation will be denied.

CAPACITY: The keyholder is authorized to refuse access to any person exceeding the authorized number of occupants (including children of any age) or to any undeclared animal. In such cases, the contract will be terminated with no entitlement to a refund. The Client agrees not to invite additional guests without Tropical Home's approval. If Tropical Home finds that the number of occupants exceeds the allowed maximum, the rental fee will be adjusted accordingly, and the contract may be terminated with immediate effect and no refund.

INVENTORY: An inventory list will be provided to the Client upon entry into the accommodation. If not signed by both Tropical Home and the Client simultaneously (contradictory inventory), the version prepared solely by Tropical Home and provided to the Client will be open to challenge within 48 hours of check-in. After this time, it will be deemed accepted without reservation unless the Client can prove a pre-existing issue or damage. An exit inventory will be conducted at the end of the rental. If no complete exit inventory is conducted or the Client conducts it alone, the absence of objection from Tropical Home within 14 days will be considered as confirmation that the accommodation was returned in good condition and the inventory was complete. In the event of damage not mentioned by the Client or detected during check-out (due to concealment, time constraints, etc.), Tropical Home has 14 days to notify the Client and provide photographic evidence of the damage.

DEPARTURE INSTRUCTIONS: Before departure, the Client must ensure that all trash has been removed and disposed of properly, glass containers deposited at the appropriate recycling points, all dishes and utensils cleaned and stored, freezers and refrigerators emptied, planchas and barbecues cleaned (ashes and charcoal bagged). These tasks are not included in the end-of-stay cleaning.

CLEANING: The Client agrees to act as a respectful tenant, take care of the accommodation, and leave it clean and tidy. Tropical Home reserves the right to withhold part of the deposit to cover additional cleaning costs if the departure instructions are not followed and if extra cleaning hours are required.

PETS: Unless otherwise stated, pets are not allowed. The presence of an undeclared pet will automatically result in a €150 deduction from the deposit for deep cleaning and sanitation.

SMOKING: Tropical Home reminds the Tenant that smoking is strictly prohibited inside the property, out of respect for future guests. If Tropical Home detects a breach of this rule, a flat fee of €150 will be deducted from the security deposit to cover deep cleaning and disinfection costs.

PARTIES PROHIBITED: Camping, setting up party tents, sound systems, fireworks, and organizing events such as weddings, communions, birthdays, or any kind of party are strictly prohibited. The Tenant also agrees to respect good neighborly conduct, particularly by avoiding noise disturbances. In case of breach, the Tenant shall, by right and without formal notice, owe a flat-rate compensation of €2,000 for damages, and may face immediate termination of the rental agreement without refund.

HOLIDAY RENTAL INSURANCE: The Tenant must have liability insurance covering holiday rentals; this is usually included in their home insurance policy. A copy of the insurance policy may be requested upon arrival.

FIRE: For safety reasons, the Tenant shall use the mobile barbecue only at the designated area and shall not move it. The fire must be extinguished after use. The Tenant must also avoid throwing cigarette butts outside ashtrays and ensure they are fully extinguished.

DAMAGE: In case of damage, the Tenant must immediately inform the local contact person. The Tenant will be held responsible for any damage unless they can prove it was not caused by themselves or their accompanying guests. The same applies in case of substitution by a third party in the rental property. The cost of the damage may be deducted from the security deposit, without prejudice to further claims if the repair costs exceed the deposit amount.

LOSS / THEFT: The Tenant agrees to use the rented property and its furnishings and equipment peacefully and will be liable for any damage or loss occurring during their stay. The Tenant must ensure that all doors and windows are properly closed during their absence, day or night. The Tenant will be held liable for any loss or damage not covered by the owner's insurance, if such issues result from theft or intrusion facilitated by a failure to observe the aforementioned precautions.

SERVICE PROVIDERS: The Tenant may not refuse access to service providers necessary for the proper functioning of the property and its facilities (pool and garden maintenance, repair technicians, etc.).

INTERNET / TV: The Tenant is not authorized to subscribe to TV channels or on-demand content. In case of breach, these charges and administrative fees will be billed to them. Regarding internet access provided in the property, the Tenant is legally and financially responsible for its use and agrees to comply with current laws and regulations. In particular (but not limited to), the Tenant agrees not to access prohibited content such as pornography, child pornography, racism, incitement to violence, or to illegally download copyrighted materials, commit crimes, or engage in hacking activities that violate the rights or safety of others.

9. Complaints and Claims

If, upon arrival, the Tenant finds that the property does not match the expected conditions or identifies any defects, they must immediately inform the local contact person. If this person cannot resolve the issue within a reasonable timeframe, the Tenant must contact the Tropical Home office. These rules also apply to any defects discovered during the stay. The keyholder may receive the Tenant's complaints and attempt to address them but is not authorized to assess their validity or any compensation claim.

Claims and requests for compensation are only valid if submitted in writing with supporting evidence within a maximum of three days after the end of the stay, and directly to the Tropical Home office. Failure to comply with these rules will result in forfeiture of the Tenant’s right to any compensation.

10. Liability

If the property is not as described in the contract and this prevents the stay from proceeding, Tropical Home will strive to offer the Tenant a replacement accommodation of equivalent quality. If this is not possible due to lack of availability, or if the Tenant refuses the alternative for valid and legitimate reasons, Tropical Home will refund all or part of the rental amount, as appropriate, and only if Tropical Home is deemed liable.

Tropical Home shall not be held liable for non-performance or improper performance of the contract in the following cases:

• The issue arises from an international event or exceptional national circumstances beyond its control.

• Tropical Home is not responsible for on-site management, which is handled directly by the property owner.

Tropical Home and the property owners shall not be held liable, and no financial compensation shall be claimed in the following situations:

• Faulty behavior or serious breaches by the Tenant.

• Unpredictable and insurmountable circumstances caused by a third party unrelated to the contracted services.

• Force majeure events, including weather conditions or other incidents that Tropical Home or its agents (e.g. the keyholder) could not foresee or prevent.

• Damages or losses suffered by the Tenant in the event of break-ins or theft. It is the Tenant’s responsibility to verify that such events are covered by their own insurance.

• Temporary outages or malfunctions of services (water, electricity, gas, TV/satellite, Internet, etc.) or household appliances and equipment at the property.

• Noise or disturbances outside the property and beyond the control of Tropical Home or the owners.

• Theft, loss, damage, or inconvenience suffered by the Tenant, their family, or other participants during the rental period. The owners offer no guarantee regarding the safety of the property or its facilities, especially concerning children under 18. It is the Tenant’s sole responsibility to ensure that young children are under constant adult supervision. The owners shall not be held liable under any circumstances.

For properties with swimming pools (private or shared), all pools comply with French safety regulations. The Tenant agrees to use the pool in accordance with the installed safety devices and to ensure their proper functioning. The owners and Tropical Home disclaim all liability in the event of an accident. The Tenant fully understands that these safety features do not replace personal vigilance, especially when it comes to monitoring children (who remain under the full responsibility of their parents).

The Tenant uses all equipment provided (barbecue, plancha, etc.) at their own risk. The owners and Tropical Home shall not be held liable for any accident or injury resulting from their use.

In case of doubt about the interpretation of these conditions, the French version shall prevail over the English version.
